Instructions for Filing Small Claims

  1. Complete the Small Claims Complaint and sign in front of a Deputy Clerk or before a Notary Public. If money is owed on an account, an itemized statement must be attached.
  2. File the original complaint with the clerk's office, along with at least two copies. One copy is needed for each Defendant and a copy for the Plaintiff (the person filing the complaint). Please provide a self-addressed stamped envelope so the file stamped copy can be returned to you by mail.
  3. The filing fee for one Defendant is $50 and $15 for each additional Defendant. Payment may be made by cash, check or money order. The Court does not accept credit cards for civil payments.

Once the case has been filed with the Court, the Court will set the case for trial within approximately 40 days from the filing date. The Defendant(s) will be served by certified mail, with a summons and a copy of the complaint. If the Defendant's certified mail is returned, the Court will issue you a Failure of Service Notice, so that you can provide the Court with new instructions for service. You will receive a copy of the summons, by regular mail, which indicates the date of the trial. Should you fail to appear for the scheduled trial, your case may be dismissed.
